This Privacy Policy explains how Real Ecom LLC (“Real Ecom”) collects, uses, shares, and protects information of the users of Real Ecom’s websites and any related mobile, software, and other applications and goods and services provided by Real Ecom (collectively, the “Services”). This Privacy Policy only applies to the Services and not to websites, applications, or services of third parties, even if they are accessible from the Services. Each third-party has its own data collection and usage practices, and Real Ecom is not responsible for any websites, applications, services, or practices of third parties. By using or accessing the Services, you signify your acceptance to this Privacy Policy and separate Terms and Conditions.

2. What types of information do we collect?
As part of its Services, Real Ecom collects the following “information” (i.e., personal information or personal data that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user or household): 
Information You Provide. We collect information from you when you provide it to us, including when you sign up to watch our case study video or send us an application or other form. Such information may include your name, email address, telephone number, and address. We may also collect, use, and share information that you provide to us or that is available through social media or Walmart relating to your use of the Services, including your reviews, comments, social media posts, messages, videos, Walmart rankings, scoreboards, earnings, experience, and sales (collectively, “Walmart Content”). We may also use services to help schedule any meetings with your calendar.
Content You Make Public. We may collect information that you have made public, such as if you post a public review or data on Walmart. You should carefully consider what information to make public as Real Ecom cannot control transmission of public content.
Transaction and Payment Information. We may gather information when you make a transaction through the Services, such as when you sign up or make a payment.
Device/Internet Connection Information. When you use the Services, we may automatically gather information made available by your web browser, internet service provider, and device, depending on your settings. For example, we may collect your IP address, information about your operating system or device, the device ID associated with your device, the date and time you access the Services, and any usage attempts.
Internet Activity Information. We may collect information about your browsing history, search history, and information regarding your interaction with a particular website, application, or advertisement, including the Services, during and after your use.
Education and Employment Information. We may collect information about your employment, employment history, or salary as it relates to the Services.
Geolocation Information. We may collect information about where you are located, both generally and at the time you access the Services, such as from your IP address.
Other Information. From time to time, we may collect other information from you, such as if you make a claim for a prize or voluntarily subscribe to promotions.
Inference Information. We may also create new information about you by drawing inferences from the information identified in the categories listed above.
Walmart Users. We collect information on behalf of and as a service provider for our customers. Such information may include your name, contact information, social security number, and financial and transaction information regarding your Walmart purchase through our customers’ Walmart stores. We will only collect, use, and disclose such information as necessary to complete, and in connection with, your Walmart purchase. 3. How and when do we collect information about you?
Real Ecom collects information about you through the following sources and means:
When You Provide Information. We collect information you provide, content you make public, transaction and payment information, geolocation information, education and employment information, and other information when you provide such information, including when you register or sign up, purchase products or services, sign up for promotional materials, upload content, post in a forum, and otherwise interact with us.  In relation to Walmart users, we collect information when you provide it in connection with or as otherwise related to your Walmart purchase for our customers’ Walmart stores.
When You Communicate with Us. We may collect information you provide, content you make public, transaction and payment information, geolocation information, education and employment information, and other information when you communicate with us.
Through Cookies, Tracking Tools, and Other Automated Technologies. When you access and use the Services, we may automatically collect your transaction and payment information, device/internet connection information, internet activity information, and geolocation information, such as through cookies, web beacons, and other automated technologies. “Cookies” are files that are placed on your device by websites you visit and identify you as a unique user. Real Ecom may use “necessary,” “preference,” “analytics,” and “advertising” cookies, some of which are placed by third parties, to customize your user experience, keep you logged in, remember your search terms, and advertise to you. You can change your cookie settings in your browser (e.g., Chrome, Edge, Firefox); however, if you disable cookies, the Services may not function correctly.

4. How is your information used?
Real Ecom uses the information outlined in Section 2 for the following purposes:
Real Ecom uses information for the following “Business Purposes” (i.e., uses reasonably necessary and proportionate to achieve an operational purpose): 
To Provide the Services. We use information to provide the Services, such as to provide you with information and services, process your payments, and fulfill your requests. In connection with Walmart users, we use your information as necessary to complete, and in connection with, your Walmart purchase for our respective client’s Walmart store; for example, we may use your information to process your order and to respond to you.
To Improve the Services. We use information to improve the Services, such as to debug and identify and repair errors that impair existing intended functionality of the Services, and to gather statistical information for analytics and to help improve performance.
To Personalize Your Experience. We use information, such as from cookies and automated technologies, to allow you to set personal preferences. We may also use services to help schedule any meetings with your calendar.
To Communicate with You. We use your information to personalize communications with you, respond to requests, and notify you of updates to our Terms or Privacy Policy.
For Security. We may use information to detect security incidents, protect against malicious, fraudulent, or illegal activity, and to investigate those responsible.
To Create Deidentified Aggregate Information. We may combine your information with that of other users to create “Aggregate Information” (i.e., statistical information about all users or a subset thereof). Aggregate Information is pseudonymized and deidentified and is not used to identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular consumer, including you. In turn, Aggregate Information may be used by Real Ecom for the Business and Commercial Purposes listed herein.
Real Ecom uses information for the following “Commercial Purposes” (i.e., uses intended to advance Real Ecom’s business interests, such as advertising or marketing a product or service):
To Advertise to You. The Services allows information to be utilized for advertising on the Services, including advertising specific to your personal interests. We may also use your information to advertise to you after you use the Services.
To Build a Profile. We may create new information about you by drawing inferences from the information identified in the categories listed in Section 2, such as to create a profile about you reflecting your preferences and trends.
To Advertise to Others. We may share your public content, such as Walmart Content, to advertise and market our Services in our advertising, such as on social media.
Scope and Legal Bases for Use. Real Ecom only processes your information to the extent that is necessary to accomplish the stated Business and Commercial Purposes, which serves as our legitimate interest. If you reside in a location governed by the GDPR, then the following are Real Ecom’s legal bases for the processing of your information: In so far as we have obtained consent for processing operations of information by the data subject, Art. 6(1) lit. a GDPR serves as the legal basis. For the processing of information necessary for the performance of a contract to which the data subject is a party, Art. 6(1) lit. b GDPR serves as legal basis. The same applies to such processing operations which are necessary for carrying out pre-contractual measures. In so far as the processing of information is required to comply with a legal obligation to which Real Ecom is subject, Art. 6(1) lit. c GDPR serves as legal basis. In the event that processing of information may be necessary to protect the vital interests of the data subject or of another natural person, Art. 6(1) lit. d GDPR serves as legal basis. If processing is necessary for the purposes of the legitimate interests pursued by Real Ecom or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, processing operations are based on Art 6(1) lit. f GDPR.

Our Affiliated Entities. Affiliated entities are directly related and have common ownership. Should we be subject to an acquisition, merger, sale, or other change of control or business entity status, we reserve the right to transfer or assign your information as part of that acquisition, merger, or sale.

6. Do we sell your information to others?
No. Real Ecom does not sell consumers’ personal information. 
7. How do we protect your information?
Real Ecom employs technical, administrative, and physical security measures that are designed to protect against the loss, misuse, and alteration of the information under our control. However, no system can be completely secure. Thus, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information will always remain secure. The safety and security of your information also depends on you. Notify us as soon as possible if you believe your security has been breached. Users are also responsible for any information obtained, provided, or shared on the Services through their use of it. 
8. How long do we keep your information?
Real Ecom will retain your information for the length of time necessary to fulfill the Business Purposes and Commercial Purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law or a valid court order. If you request deletion of your information, your request will be processed according to the timeframes indicated therein and/or pursuant to any applicable legislation.  
9. Do we transfer your information to a different country?
Your connection will be through and to servers located in the United States, and all information you provide will be processed and maintained in our web servers and internal systems located within the United States. By using the Services, you authorize and specifically consent to the transfer of personal information to the United States and its storage and use as specified herein.
11. How do we protect the privacy of children?
You must be at least 18 years of age to use the Services. Real Ecom will never knowingly collect any personal information about children under the age of 13. If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be deleted from our database. Because we do not collect such information, we have no such information to use or to disclose to third parties. We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).
10. What are your rights when it comes to accessing, correcting, or deleting your information, and how can you exercise them?
Under certain privacy legislation, such as the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR), you may request to correct, amend, access, or delete information. These requests can be made by contacting us through our Services or by emailing us at contact@realecomautomation.com. We will not discriminate against you for making a privacy request or asserting privacy rights. To protect your privacy and security, we may take reasonable steps to help verify your identity before granting your request. We may also take steps to verify any authorized agent making a request. California Shine the Light Disclosure
Under California’s “Shine the Light” law, California residents who provide personal information to the Services may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
12. How can you receive and opt-out from marketing communications?
By providing your email address or other contact information, you expressly consent to receiving marketing communications from us. Providing consent to promotional communications is not a condition of purchasing any goods or services. You can unsubscribe to marketing communications at any time by following unsubscribe instructions in each communication or by contacting us as outlined in Section 15. If you unsubscribe from advertising content, we may still send you any non-promotional communications, such as updates to our Terms or Privacy Policy.
13. Do we respond to Do Not Track (DNT) Signals?
DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked. Real Ecom does not currently respond to DNT requests.
14. How will you know when we change the Privacy Policy?
Each time you use the Services, the then-current version of this Privacy Policy will apply. Although most changes are likely to be minor, we reserve the right to modify this Privacy Policy by posting such modification on the Services at any time. Unless we receive your express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy and not to information collected under any earlier version.
